TERMS & CONDITIONS
Effective Date: June 5, 2026
Welcome to Old Coyote Arts, the creative partnership of Katie and Steve Mac. Old Coyote Arts encompasses the associated creative brands Old Coyote Ceramics and Steve Mac Art.
These Terms & Conditions govern your use of www.oldcoyotearts.com and your purchase of products, artwork, and services through the website.
The domains oldcoyoteceramics.com and stevemacart.com may direct visitors to www.oldcoyotearts.com. In these Terms & Conditions, “Old Coyote Arts,” “Old Coyote Ceramics,” “Steve Mac Art,” “we,” “us,” and “our” refer collectively to Old Coyote Arts and its associated creative brands.
By accessing or using this website, placing an order, or purchasing a product through the website, you agree to be bound by these Terms & Conditions. If you do not agree with these Terms & Conditions, please do not use the website or place an order.
SECTION 1 – GENERAL CONDITIONS
We reserve the right to refuse service, cancel orders, or limit sales to any person or geographic region when permitted by applicable law.
You agree not to use this website, its products, artwork, images, text, or other content for any unlawful, unauthorized, fraudulent, or prohibited purpose.
You may not use our products, artwork, website content, or services in violation of applicable federal, state, or local laws.
SECTION 2 – PRODUCTS AND ARTWORK
All artwork, ceramics, jewelry, and other products are subject to availability.
Our products are handmade and/or original works of art. Because of the nature of handmade and individually created work, slight variations in color, glaze, texture, shape, size, finish, surface, framing, or other characteristics may occur.
These variations are a natural part of handmade and original artwork and are not necessarily considered defects.
For pit-fired ceramics and other works made using processes that produce unpredictable results, each piece may have unique markings, color variations, surface effects, or other characteristics that cannot be precisely recreated.
We make reasonable efforts to accurately photograph and describe our products. However, colors may appear differently depending on your monitor, screen, device, or settings.
Product descriptions, images, specifications, availability, and pricing may be changed, updated, or discontinued at any time without notice.
SECTION 3 – CUSTOM ORDERS AND CUSTOM REQUESTS
Custom orders and custom artwork may be subject to separate agreements, pricing, timelines, deposits, and approval requirements.
Before beginning certain custom work, we may require additional information, reference images, design details, payment, or a deposit.
Because custom and commissioned work is created specifically for the customer, custom orders may be subject to different cancellation, return, refund, and approval terms. Any terms that differ from these general Terms & Conditions will be communicated to the customer before the custom work begins.
Unless otherwise agreed in writing, a customer's purchase of custom artwork does not transfer copyright, reproduction rights, licensing rights, or commercial usage rights.
SECTION 4 – ORDER ACCEPTANCE AND PAYMENT
Submitting an order does not guarantee that the order will be accepted.
We reserve the right to refuse, limit, or cancel an order for reasons including, but not limited to:
• Suspected fraud or unauthorized activity;
• Pricing, description, or listing errors;
• Product availability issues;
• Errors in order or payment information;
• Shipping or address issues; or
• Other circumstances that make fulfillment impractical or unavailable.
If we cancel an order after payment has been received, we will issue an appropriate refund for the canceled portion of the order.
All prices are listed in U.S. Dollars unless otherwise stated.
Applicable sales tax and shipping charges may be added to an order as required or applicable.
Payment must be successfully received or authorized before an order is processed for shipment.
SECTION 5 – SHIPPING AND DELIVERY
Shipping times provided on the website are estimates and are not guaranteed unless expressly stated otherwise in writing.
We are not responsible for delays caused by shipping carriers, weather, natural disasters, customs, transportation disruptions, or other events beyond our reasonable control.
Customers are responsible for providing complete and accurate shipping information. We are not responsible for delays, additional shipping costs, or delivery problems resulting from incorrect or incomplete information provided by the customer.
If a package is delayed, lost, or damaged during shipping, customers should contact us as soon as possible. We may assist with communicating with the shipping carrier or pursuing an available claim, when appropriate.
Shipping-related issues may be handled on a case-by-case basis depending on the circumstances, the shipping method, carrier policies, and applicable law.
SECTION 6 – RETURNS, REFUNDS, AND DAMAGED ITEMS
Due to the handmade and original nature of our artwork and products, all sales are final unless otherwise stated in writing or required by applicable law.
If an item arrives damaged, please contact us as soon as possible and, where possible, within 7 days of delivery. Please provide photographs of the damaged item, the packaging, and any visible shipping damage.
We may request additional information or photographs to evaluate a damaged-item claim.
Depending on the circumstances, we may determine that an eligible claim qualifies for a replacement, repair, store credit, partial refund, or full refund.
Any resolution will be determined based on the specific circumstances of the situation and applicable law.
SECTION 7 – COPYRIGHT AND ARTIST RIGHTS
All artwork, photographs, product designs, logos, text, graphics, images, illustrations, written content, and other materials appearing on this website are owned by or licensed to Old Coyote Arts, Old Coyote Ceramics, Steve Mac Art, or the respective artist or rights holder and are protected by United States copyright and other intellectual property laws.
Except as expressly permitted by law or with prior written permission, you may not copy, reproduce, distribute, modify, publish, display, create derivative works from, sell, license, or commercially use any artwork, photographs, product designs, logos, text, graphics, images, or other website content.
The purchase of an original artwork, ceramic item, jewelry item, or other product does not transfer copyright, reproduction rights, licensing rights, or commercial usage rights.
Copyright and other intellectual property rights remain with the applicable artist or rights holder unless expressly transferred in a separate written agreement.
SECTION 8 – USER-SUBMITTED CONTENT
If you voluntarily submit photographs, testimonials, reviews, comments, messages, or other content to us, you represent that you have the right to submit that content.

We will not knowingly use a customer's submitted content in a manner that falsely implies endorsement or affiliation without appropriate permission.
SECTION 9 – THIRD-PARTY SERVICES AND LINKS
Our website may use third-party services for website hosting, payment processing, shipping, analytics, email marketing, and other business functions.
Our website may also contain links to third-party websites, social media platforms, or other external services.
We are not responsible for the content, policies, security, availability, or practices of third-party websites or services.
Your use of third-party services may be subject to the terms and privacy policies of those third parties.

To the fullest extent permitted by applicable law, our total liability relating to a product purchase will not exceed the amount actually paid for the specific product giving rise to the claim.
Nothing in these Terms & Conditions limits liability that cannot legally be limited or excluded under applicable law.
SECTION 12 – INDEMNIFICATION
To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless Old Coyote Arts, Old Coyote Ceramics, Steve Mac Art, and their owners, artists, representatives, and service providers from claims, liabilities, damages, losses, and expenses arising from your violation of these Terms & Conditions, your misuse of the website, or your violation of applicable law or the rights of another person.
SECTION 13 – GOVERNING LAW AND DISPUTES
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of Washington, without regard to conflict-of-law principles.
Any dispute arising from or relating to these Terms & Conditions, the website, or a purchase made through the website shall be subject to applicable laws and the jurisdiction of courts located in the State of Washington, unless otherwise required by applicable law.
